Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Flimpa website located at flimpa.com, including all tools, APIs, and associated functionality (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must discontinue use of the Service.

2. Description of Service

The Service is operated by Artur Degtev, an individual providing online tools for file conversion, document processing, text editing, image manipulation, code formatting, and data handling.

The specific tools available may change over time. Features may be added, modified, or removed without prior notice.

3. Eligibility & Compliance

You may only use the Service if it complies with all applicable laws and regulations in your jurisdiction. You are solely responsible for ensuring that your use of the Service is legal.

4. User Files and Content

Ownership

You retain all rights, title, and interest in any files or content you upload to the Service. Uploading does not transfer ownership to the Operator.

Responsibility for Content

You are solely responsible for:

  • the files you upload;
  • the data you process;
  • any consequences resulting from your use of the Service.

You represent and warrant that you have all necessary rights, licenses, and authority to upload and process such content.

Technical Tool Disclaimer

Flimpa is a passive technical tool. I do not initiate transfers, select recipients, or modify the substance of your files. You acknowledge that you are the sole initiator of any processing regarding uploaded content. I am not liable for the contents of your files or any infringement of third-party rights caused by your use.

Processing and Storage

Files are processed on a temporary basis and are not intended for permanent storage. They are automatically deleted after processing or upon expiration of a short technical retention period. Please maintain your own backups of important files.

5. Prohibited Use

You agree NOT to use the Service to:

  • violate any applicable laws or regulations;
  • infringe on intellectual property rights;
  • upload viruses, malware, or engage in phishing activities;
  • distribute malicious or illegal content;
  • bypass security mechanisms;
  • interfere with or disrupt the integrity of the Service;
  • attempt unauthorized access to systems;
  • launch Denial-of-Service (DoS) attacks;
  • perform automated scraping or excessive requests that negatively impact system stability.

6. Intellectual Property

The Service, including its design, software, algorithms, and trademarks, is owned by the Operator and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service itself.

7. Availability & Changes

While I strive for reliability, I do not guarantee:

  • uninterrupted availability;
  • error-free operation;
  • compatibility with all devices or browsers;
  • permanent availability of specific tools.

The Service may be modified, suspended, or terminated at any time without notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

I DO NOT GUARANTEE THAT FILE CONVERSION RESULTS WILL ALWAYS BE PERFECTLY FORMATTED, ERROR-FREE, OR IDENTICAL TO THE SOURCE IN TERMS OF VISUAL FIDELITY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE OPERATOR EXCEED ONE HUNDRED US DOLLARS ($100 USD). This limitation does not apply to liability for death or personal injury caused by gross negligence or willful misconduct where such exclusion is prohibited by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Operator and its affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • your use of the Service;
  • content you upload;
  • your violation of these Terms;
  • your violation of any third-party rights (including copyright).

11. Third-Party Services

The Service may utilize third-party providers for analytics (e.g., Yandex Metrica), hosting, or infrastructure. Such services operate under their own terms and privacy policies. The Operator is not responsible for the practices of third parties outside of our reasonable control.

12. Privacy

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

13. Modifications

I may update these Terms at any time. Updated versions will be posted on the website with a revised effective date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland. If you are a consumer residing in the European Union or other jurisdictions with mandatory local protections, those laws may prevail.
